Criminal compliance
In the framework of any corporate policy, compliance with the law will always be the fundamental basis.
It is precisely these business policies based on compliance with the law that lead us to the need to establish a Crime Prevention Model in the organisation, known as Criminal Compliance.
Criminal compliance means complying with current legal regulations in order to avoid unlawful or even criminal conduct that may lead to criminal liability.
The speciality of criminal compliance lies in the type of risks that we must prevent, which are none other than criminal risks, although, given that we are faced with a wide variety of criminal offences that cover all areas of the company, Criminal Compliance extends to all areas of compliance.

Internal information systems (Whistleblowing channels)
All companies with 50 or more employees must have an Internal Information System in place.
On 13 March 2023, the new Law 2/2023 of 20 February on the protection of persons who report regulatory violations and the fight against corruption came into force.
This law transposes Directive 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of EU law.
The Spanish Standard requires all companies with 50 or more employees to have an Internal Reporting System in place, also known as an ethics channel or whistleblowing channel, in accordance with the requirements set out in the standard. Failure to implement and/or adapt it may lead to the commission of a very serious offence, which is punishable by a fine of up to 1,000,000 euros.
The Internal Information System has to meet a number of minimum requirements, such as the following:
- Be designed, established and managed in such a way as to ensure the confidentiality of the informant and any person involved.
- Only a natural person can have access to the information communicated through this channel.
- The company has to integrate the different channels previously existing in this new system.
- A system manager is to be appointed by the governing body.
- The law allows outsourcing the management of the complaints system or channel.
- Such a system should have a policy that publicises its principles, as well as a detailed management procedure.
